The ground rules for using primeerosion.com. Plain language where we can, legal language where we have to.
Last updated: September 25, 2026
These Terms of Service (the "Terms") govern your use of primeerosion.com (the "Site"), operated by Prime Erosion LLC ("Prime Erosion," "we," "us," or "our"), an erosion control and hydroseeding company based in Wilmington, North Carolina. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The Site describes our services, including hydroseeding, straw seeding, silt fence installation, inlet protection, pond baffles, pond maintenance, soil sampling, and wildlife food plots. Content on the Site is provided for general information only. It is not engineering, legal, or regulatory advice, and reading it does not create a contractor and client relationship. Every property is different, and nothing on the Site should be relied on as a recommendation for your specific site without an assessment.
Land-disturbing work in North Carolina is regulated under the Sedimentation Pollution Control Act of 1973 and related state and local rules. Among other requirements, land disturbances of one acre or more generally require an approved erosion and sedimentation control plan before work begins, and construction activities may require coverage under the NCG01 construction stormwater general permit.
Responsibility for obtaining permits, plan approvals, and regulatory compliance rests with the property owner or the financially responsible party for the project, unless Prime Erosion expressly assumes a specific obligation in a signed written agreement. Content on the Site is not a substitute for an approved plan or for direction from the North Carolina Department of Environmental Quality or your local permitting authority.
Submitting an inquiry or estimate request through the Site does not create a contract, and estimates discussed on the Site, by phone, or by email are not binding offers. Pricing depends on a site assessment, including factors such as acreage, soil conditions, slope, access, season, and materials.
All services are performed under a separate written proposal or service agreement. If these Terms conflict with a signed agreement between you and Prime Erosion, the signed agreement controls for the services it covers.
Hydroseeding, straw seeding, and food plot establishment are living processes that depend on conditions beyond our control, including weather, rainfall, temperature, soil conditions, watering and irrigation after application, and traffic or wildlife activity on the treated area. Germination times and coverage vary from site to site and season to season.
Unless expressly stated in a signed service agreement, Prime Erosion does not guarantee germination, coverage, or vegetation establishment. Photos on the Site show examples of past work, not promised results for your property. Proper watering and care after application are typically the customer's responsibility and have a major effect on results.
Erosion control and seeding work is weather and season dependent. Scheduled dates may shift due to rain, wind, temperature, ground conditions, or safety considerations. We will communicate changes as early as we reasonably can.
Before ground-disturbing work, underground utility locates are requested through North Carolina 811 as required by law. Standard 811 locates cover public utilities only. Customers are responsible for identifying private lines that 811 does not mark, such as irrigation systems, septic components, landscape lighting, and private water or power runs, and for providing safe access to the work area.
You agree not to use the Site in any way that violates the law, interferes with the Site's operation, attempts to gain unauthorized access to any system, or harvests or scrapes content or data from the Site.
The Site and its content, including text, logos, graphics, photos, and design elements, are owned by Prime Erosion LLC or its licensors and are protected by copyright and trademark law. You may not copy, reproduce, or use Site content for commercial purposes without our written permission.
The Site may link to third-party websites and services, including social media. We do not control and are not responsible for their content or practices.
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Prime Erosion disclaims all warranties regarding the Site, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components.
To the fullest extent permitted by law, Prime Erosion will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or its content. This section applies to use of the Site; liability relating to services we perform is governed by the applicable signed service agreement.
You agree to indemnify and hold harmless Prime Erosion LLC and its owners and employees from claims, damages, and expenses arising out of your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute relating to the Site will be brought in the state or federal courts located in New Hanover County, North Carolina.
We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Your continued use of the Site after an update means you accept the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force and effect.
